TERMS AND CONDITIONS - AIDACARE AT Innovations APT Competition

1. The Promoter is: Aidacare Pty Ltd. (ABN 40 134 398 833) of registered office address: Industry Park Building, 3A/1 Moorebank Ave, Moorebank NSW 2170. The above-mentioned company will be hereafter jointly referred to as 'Promoter.’

2. Employees of the Promoter or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition. 

3. To enter the giveaway an entrant must post a photo of their favourite assistive technology product featured at the event, and the reason why, as well as using the hashtag #AIDACAREATINNOVATIONS on Facebook, Instagram or LinkedIn.

4. Entry is open only to the Entrants, excluding the Exclusions. 2.2 This Competition will be conducted during the Entry Period. Entries must be received by the Promoter during the Entry Period. Entries received after the Entry Period will not count 

5. The Entry time period for this competition: 24th - 26th July, 2024.

6. No responsibility can be accepted for entries not received by the competition organiser for any reason.

7. The rules and conditions of the competition and the prize for each winner are as follows:

  • The entrant must post a photo on either Facebook, Instagram, or LinkedIn of an assistive technology product being showcased at an Aidacare AT Innovations APT Event.
  • The entrant must state the reason why the product being photographed is their favourite.
  • The entrant must use the hashtag #AIDACAREATINNOVATIONS when posting their image and answer on social media.
  • Multiple entries are permitted per person attending the Aidacare AT Innovations event. 
  • The Prize may take up to four (4) weeks to be sent to the Winner.
  • The winning entry will be judged on, but not limited to; originality, creativity, hashtags and story telling.

8. This Competition is a game of skill, and chance plays no part in determining the winner. All entries will be judged individually on their merits based on the Judging Criteria. 

9. Social media conditions: 1. This Competition may be promoted through third-party websites such as LinkedIn, Facebook and/or Instagram.

10. By entering this Competition, Entrants may be subject to terms and conditions of third-party websites such as LinkedIn, Facebook and/or Instagram. 

11. This Competition is in no way sponsored, endorsed or administered by, or associated with LinkedIn, Facebook and/or Instagram. Entrants understand that they are providing their information to the Promoter, LinkedIn, Facebook, and/or Instagram. 

11. Entrants are solely responsible and liable for the content of their Entries and any other information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, LinkedIn, Facebook, Instagram and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Competition. 

12. Any questions, comments or complaints about the Competition must be directed to the Promoter, and not to LinkedIn, Facebook or Instagram.

13. The Entrant who submits the best Entry (as determined by the judges) will win the Prize(s) (Winner). The judges’ decision is final, and the Promoter will not enter into correspondence regarding the result. 

14. Entrants are solely responsible and liable for the content of their Entries and any other information they transmit to other Internet users. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, LinkedIn, Facebook, Instagram and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Competition. 

15. The Promoter reserves the right to verify the validity of an Entry and to disqualify an Entrant for tampering with the entry process or for submitting an Entry that does not, in the Promoter’s sole discretion, comply with these Terms and Conditions. 

16. The Winner consents to the Promoter’s use of the Winner’s name, likeness, image, picture, voice, statements, testimonials or quotations for promotional, marketing and publicity purposes in any media worldwide, without any fee being paid to the Winner. 

17. Entrants must personally and manually submit an Entry using an internet browser. The Promoter reserves the right to reject an Entry if it reasonably forms the opinion that an Entry has been created and/or submitted using automated entry means or a computer entry service.

18. To be eligible to win a prize in this Competition, an Entry must not: (a) infringe the intellectual property or other rights of a third party; (b) be incomplete or illegible; or (c) be unlawful, defamatory, abusive, insulting, 

19. The Promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the Promoter.

20. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

21. No cash alternative to the prizes will be offered. The prize is not transferable. Prizes are subject to availability, and we reserve the right to substitute any prize with another of equivalent value without giving notice.

22. The winner will be chosen by the Aidacare marketing team. This will be conducted at the Aidacare Geelong office, 77 Barwon Terrace, South Geelong Vic 3216

23. The winner will be notified via associated account by Friday, the 26th of July between 4-5pm AEST. The winner's name will be published on the Aidacare social media pages.

24. The Promoter will notify the winner when and where the prize can be collected.

25. The prize for the winning entry is a $500 Professional Development Package and must be used on one event.

26. The total prize is valued upto $500. The prize will be agreed upon with the winner through discussions with Aidacare.

27. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.

28. By entering this competition, an entrant is indicating their acceptance and agreement to be bound by these terms and conditions.

29. The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.

30. The winner agrees to the use of their name and image (if taken) in any internal publicity material. Any personal data relating to the winner(s) or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

31. The winner’s name may be published on the Aidacare website, Facebook, Instagram and LinkedIn social media page, or in Aidacare Newsletters.

32. The Winner must claim the Prize within the Claim Period of 7 days since they are notified. The Promoter will not be responsible for any delay, loss or damage to the Prize once it has left the Promoter’s or supplier’s premises. Winner has 12 months to redeem package and must be redeemed in one go.

33. If the Winner is unable to comply with these Terms and Conditions and/or does not claim the Prize within the Claim Period, the Promoter reserves the right to award the Prize to the Entrant with the next best Entry (Unclaimed Prize Winner), as determined by the judges at the Unclaimed Prize Determination.

34. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. You are providing your information to the Promoter and not to any other party.

35. To the fullest extent permitted by law, the Winner participates in this Competition, and uses the Prize, at his or her own risk.

36. To the fullest extent permitted by law, the Promoter, its related bodies corporate and the suppliers, agencies and other companies involved in this Competition assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.

37. The Promoter is bound by the Privacy Act 1988 (Cth). Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to conduct the Competition, publicise the name of the Winners and where Entrants have consented to the receipt of such information, send Entrants marketing, advertising and promotional material.

38. These Terms and Conditions are governed by the laws of the relevant Australian jurisdiction in which the competition is being held.
